The committee on memorial from Oakland Church read the following report which was adopted:
Your special committee appointed to consider the memorial from Oakland Congregation beg leave to submit the following report:
We recommend that the presbytery appoint a commission to call Rev. L. McWherter to appear before it to give answer to certain charges for non-affiliation and for preaching doctrine contrary to the teaching of our church and the disturbance of the peace and unity thereof.
We recommend that the commission be composed of the following persons: Rev. R. B. Collier, J. B. Huntsman, R. M. Dobson, J. J. Carroll, and Elder G. M. Smith.

To the ministers of the East Tennessee Presbytery and church session of the same:
You are hereby called to meet in special session at the C. P. Church house in Greeneville, Tennessee, on Wednesday, December 13, 1899, at 10 o'clock a.m. for the purpose of hearing and acting upon the report of the commission appointed at the last meeting of presbytery to investigate and hear evidence of charges preferred by it against Rev. L. McWherter at its last sitting.
Further, to take any original steps in reference thereto that in its wisdom may be deemed advisable or necessary to a full and complete investigation in reference to is conduct as a minister from reports relating thereto.
Only delegates to last sitting of presbytery or their alternates will be competent to sit as representatives from the different churches.

The commission made the following report:
Your commission appointed at the last sitting of presbytery to call Rev. L. McWherter to answer to certain charges made against him and to investigate the same met in the Cumberland Presbyterian Church in Greeneville, Tennessee, on November 25, 1899, having duly notified Rev. L. McWherter to meet said commission. Members present; Elder G. M. Smith, Revs. R. M. Dobson and R. B. Collier.
Rev. L. McWherter refused to meet said commission claiming the action of presbytery to be irregular.
Your commission, after due consideration, think best to refer the whole matter back to presbytery. Notwithstanding, your commission consider the action of presbytery to be regular in the main, yet we think the matter could be more satisfactorily consummated in open presbytery.
Respectfully submitted, R. B. Collier, R. M. Dobson, G. M. Smith, J. B. Huntsman, J. J. Carroll

which report was adopted by unanimous vote.
The letter of Rev. L. McWherter dated Nich, Grainger Co., Tennessee, December 11, 1899, was read after which, as per is request, the portion of the record of last meeting of presbytery was read.

The following paper in explanation and enlarging upon charges heretofore made was read and ordered to be spread of record.
Whereas, the East Tennessee Presbytery of the Cumberland Presbyterian Church, being convened in special session at Greeneville, Tennessee, Dec. 13, 1899, in obedience to call of the moderator,
Therefore, said presbytery brings and prefers the following accusations against Rev. L. McWherter, he being a regularly ordained minister thereof, and has for a number of years last past been and still is continuously preaching a theory of doctrine contrary to the teachings of the Cumberland Presbyterian Church, to wit: sinless perfection in a sense, or second blessing theory of sanctification.
This being done on one occasion at Gass Bridge, Greene County, Tenn., about July 25, 1899.
In support of which will be presented the testimony of Revs. R. B. Collier, W. F. Self, and C. W. Duncan.

The presbytery also charges that said L. McWherter has admitted in open presbytery that he teaches doctrine contrary to the confession of faith of the Cumberland Presbyterian Church, and believes and hols to and teaches the second work of grace and sinless perfection in some sense and the second blessing theory of sanctification.
In support of which reference is made to the record of the presbytery at Shilo, April 2, 1898.

That the teaching of said McWherter, as heretofore charged, has been greatly to the disturbance of the peace and unity of some of the congregations of the Cumberland Presbyterian Church in your bounds, especially so to the Greeneville Congregation.
As witness for this, we refer to elders of said congregation as follows: L. F. Self, J. H. Doughty, R. A. Brown, and others.

Also that said L. McWherter has been for more than two years, last past and still is, devoting himself to evangelistic work, so called, without having obtained of presbytery, of which he is a member, permission or in any way acting under the direction of the presbytery to which he is a member.
For evidence that he is so doing, reference is made to the minutes of the presbytery and to letters written by said McWherter.

Said McWherter has failed for some time to affiliate with the presbytery in its work.

Wherefore, in view of the foregoing charges, it is deemed advisable by the presbytery that steps should be taken in reference thereto and such action had as will be sufficient to correct the error into which the brother has fallen; or if necessary, remove him from membership in the presbytery, or make any order in relation thereto that may be deemed right under all the facts and circumstances in this case.
That these charges stand as additional specifications, etc. to the former action of presbytery and in no sense are meant to conflict therewith.
Which was by unanimous vote concurred in and ordered spread upon the minutes for further proceedings thereunder.

The records and the charges entered of record against Rev. Leroy McWherter were read; and also the open letter of said McWherter to the East Tenn. presbytery of date Jan. 6, 1900 published in the Greeneville Democrat.
Whereas, Rev. L. McWherter having been heretofore duly cited to appear before the presbytery at this time and having failed to do so, it is therefore ordered that said McWherter be cited again to appear before said presbytery again at a called, on special meeting thereof, to be held at Midway, Tennessee, at the C. P. Church on Friday, March 2, 1900 at 9 O'clock, a.m. to answer the charges heretofore made against him.

The following proceedings were had an ordered entered of record.
Whereas, Rev. L. McWherter states in open presbytery that he is not ready for trial on the charges heretofore preferred against him
And whereas, he declines to agree to the appointment of a committee to take the testimony in reference to said charges and present, it to the regular meeting of presbytery with any additional testimony he may wish to present at presbytery.
Therefore in consideration of said McWherter's statement that he is not ready , it is deemed advisable that the presbytery do adjourn to take said matter up at the regular sitting of presbytery.
Which resolution and continuance order was carried by unanimous vote.
Rev. L. McWherter was then upon his request granted the privilege of giving the stated clerk a list of persons he wished summoned as witnesses - The following names were presented and entered of record, Dr. C. D. Willis, Dr. R. C. Smith, L. F Self, R. A. Brown, R. H. Sanders, James Armitage.

The hour of 10 O'clock a.m. was set apart to take and consider the charges heretofore preferred against Rev. L. McWherter.

The house for the consideration of the charges against Rev. L. McWherter having arrived that item of business was taken up.
After the reading of the charges in open presbytery, and a verbal statement of Rev. L. McWherter, in which he in substance admitted the first two and denied the others. It was thereupon at the suggestion of said McWherter he consenting, thereto as did also the presbytery that said McWherter might submit his answers in writing and suggest in writing a method of settlement which the presbytery could adopt or reject as was deemed right by the presbytery. Presbytery recessed until 1:30 P.M.
Recess out presbytery called to order. The consideration of the item of business in hand when recess was taken was resumed.
Rev. L. McWherter read his answer and request as to method of procedure which after some discussion withdrawn.
Thereupon said McWherter having admitted in open presbytery that charges no. 1 & 2 were in substance correct,
The presbytery thereupon withdrew all the other charges against said McWherter.
And it was then agreed that each side be allowed one hours time to discuss the question.
At the request of Rev. L. McWherter the regular order was suspended for 25 minutes, before commencing the argument.

The time for the discussion of the charges against Rev. L. McWherter having arrived that item was taken up and argument having been heard and J. J. Coile being called to the chair.
Rev. R. B. Collier, moved that he charges be sustained as being sufficient to depose said McWherter, which motion was carried.

It was therefore ordered by a vote of 20 aye and 5 no's that Rev. L. McWherter be deposed and prohibited from exercising the privileges as an ordained minister under the authority of this presbytery.
